1. Acceptance of Terms

By accessing or using the Kamride platform — including our website and mobile applications (the “Service”) — you agree to be bound by these Terms of Service (“Terms”) and by our Privacy Policy, which is incorporated by reference. If you do not agree, you may not use the Service. We may update these Terms from time to time (see Section 18); continued use after an update constitutes acceptance.

These Terms apply to every Member, whether acting as a Driver, a Passenger, or simply a registered user. Kamride is operated by BetfienInc (“Company”, “we”, “us”, “our”).

2. Definitions

  • Member — any person who has registered an account on the Service.
  • Driver — a Member offering spare seats in their own vehicle for a Trip.
  • Passenger — a Member booking seats in a Driver’s vehicle.
  • Trip — a journey between a stated origin and destination, on a stated date and time, published by a Driver.
  • Contribution — the amount a Passenger pays toward a Driver’s travel costs. It is cost-sharing, not profit.
  • Booking Fee — the service fee Kamride charges, added on top of the Contribution and paid by the Passenger.
  • Booking — a confirmed reservation of one or more seats on a Trip.

3. Nature of the Service — Cost-Sharing Only

Kamride operates an online marketplace that connects Drivers and Passengers for shared, non-commercial travel. Kamride is not a transportation carrier, taxi service, travel agency, insurer, agent, or broker, and is not a party to the agreement formed between a Driver and a Passenger.

  • Drivers may only recover a fair share of the actual costs of the Trip and must not profit from carpooling or operate commercially.
  • Kamride sets or caps the Contribution to keep Trips within cost-sharing limits.
  • The Service does not guarantee that any Trip will be published, booked, or completed.

4. Eligibility & Account Registration

To register and use the Service you must:

  • Be at least 18 years old and able to enter a legally binding contract;
  • Provide and maintain accurate information — legal first and last name, age, a clear face photo, a valid email, and a verifiable phone number;
  • Verify your email and phone; Drivers must additionally provide a valid driver’s licence (Section 9) and may be asked to complete identity verification.
  • An account is personal and non-transferable. You may not share, sell, or operate multiple accounts.
  • You are responsible for keeping your credentials confidential and for all activity under your account, and must report any unauthorized use immediately.
  • A minor under 14 may travel only when accompanied by a responsible adult Member.
  • Kamride may refuse, suspend, or terminate any account at its reasonable discretion (Section 17).

5. Driver Obligations

As a Driver you agree to:

  • Drive lawfully, carefully, and never under the influence of alcohol or drugs;
  • Use a roadworthy vehicle with a maximum of 7 seats, in good condition, that you verify before each Trip;
  • Be the primary driver named on the account — you may not delegate the drive;
  • Hold valid insurance that covers the carriage of passengers for the Trip (Section 9);
  • Publish accurate Trip details with clear meeting point(s) — limited to two meeting points within the same metropolitan area;
  • Arrive at the pickup point at least 5 minutes early, wait a reasonable time, and notify Passengers of any change before departure;
  • Carry only the Passengers who booked, in the seats offered, without unstated passengers or charges for extras (deliveries, detours, waiting time).

Prohibited: commercial/for-profit operation, speculative or fake Trips, posting Trips on behalf of anyone else, and any conduct that could invalidate your insurance.

6. Passenger Obligations

As a Passenger you agree to:

  • Book and pay only online through the Service (Section 7) — no cash, e-transfer, or off-platform payment;
  • Arrive at the agreed meeting point on time and be ready to depart at the scheduled time;
  • Respect the Driver’s stated preferences (luggage, pets, smoking, etc.);
  • Verify the Driver and vehicle details, and behave respectfully toward the Driver and other Passengers.

You are solely responsible for your interactions with other Members. Exercise the same caution you would when meeting any stranger.

7. Payments, Contributions & Fees

  • All payments are processed securely online by our payment processor (Stripe). Kamride does not store full card details.
  • All transactions are in Canadian dollars (CAD).
  • The Passenger pays the Contribution plus the Booking Fee at the time of booking. Contact details to coordinate the Trip are shared only after a Booking is confirmed.
  • Driver payouts: Contributions (net of applicable fees) are paid to the Driver’s nominated payout method after a clearing period of [4] days from the Trip, during which disputes may be raised.
  • Members must respond to identity- or fraud-verification requests. Kamride may hold or freeze funds, or restrict access, where fraud is reasonably suspected or a dispute is unresolved.

8. Cancellations, No-Shows & Refunds

Driver cancellation

  • A Trip with no booked Passengers may be cancelled at any time at no penalty.
  • Cancelling a Trip with booked Passengers: Passengers are refunded 100% of the Contribution and Booking Fee. Repeated or at-fault cancellations may lead to account review or suspension.

Driver no-show

A verified no-show attributable to the Driver results in a full Passenger refund and may result in immediate account suspension.

Passenger cancellation

  • 24+ hours before departure: full Contribution refunded; Kamride may retain the Booking Fee.
  • Less than 24 hours before departure: the Driver receives [50%] of the Contribution; Kamride retains the Booking Fee.
  • After scheduled departure / no-show: the Driver receives 100% of the Contribution; no refund to the Passenger.
  • Repeated cancellations (even outside the free window) may result in suspension.

Dispute window: Bookings and payments may be disputed up to [4] days after the scheduled departure. After that window, payouts proceed and no further refund is processed.

9. Driver’s Licence & Insurance

  • Drivers must hold a full, valid, non-expired licence in their own name (no learner/probationary/restricted licences). Foreign licences may be accepted but are not guaranteed.
  • Drivers must maintain valid automobile insurance that covers the carriage of passengers for each Trip, and confirm this coverage before every Trip.
  • Commercial use can void private insurance. Members accept full financial responsibility for any claim not covered by their insurer. Kamride is not an insurer and is not liable for any insurance claim or denial.
  • Drivers must comply with applicable provincial rules (e.g., the Ontario Public Vehicles Act and equivalent provincial carpool rules). Drivers legally required to use an alcohol ignition interlock are not permitted to drive on the Service.

10. Prohibited Conduct & Community Standards

You must not, and must not help others to:

  • Harass, abuse (verbally or physically), threaten, stalk, or impersonate anyone;
  • Discriminate on the basis of race, colour, national or ethnic origin, religion, sex, gender identity, sexual orientation, age, or disability;
  • Post unlawful, defamatory, infringing, or offensive content;
  • Harm minors, forge identities/headers, or collect others’ data without consent;
  • Distribute spam or malware, interfere with or damage the Service, scrape or recreate its data, or use it for any commercial purpose;
  • Treat Kamride staff disrespectfully.

Violations may result in immediate account closure. Suspected criminal conduct should be reported to the authorities and to Kamride.

11. Reviews, Content & Feedback

Members may post profiles, messages, and ratings. You are solely responsible for your content and grant Kamride a licence to host and display it for operating the Service. Suggestions or feedback you submit may be used by Kamride without obligation or compensation.

12. Intellectual Property

The Service, including its software, trademarks, design, and content, is owned by Kamride/BetfienInc or its licensors and is protected by law. You may not copy, modify, distribute, sell, frame, or create derivative works from any part of the Service without our prior written permission. Ordinary hyperlinks to the Service are permitted.

13. Identity Verification & Background Checks

Kamride may verify Members’ email, phone, identity documents, and (for Drivers) driver’s licence, including through third-party verification providers. Kamride does not perform criminal background checks and cannot guarantee the conduct, identity, or fitness of any Member. Members interact at their own risk.

14. Disclaimers (“As Is”)

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Kamride disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and uninterrupted or error-free operation. Kamride does not warrant any Trip, Driver, Passenger, or outcome.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Kamride and its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for the acts or omissions of any Member. Kamride’s total aggregate liability arising out of or related to the Service shall not exceed the greater of the Booking Fee paid for the relevant Trip or CAD $25.

Quebec residents: Nothing in Sections 14–16 limits any right, warranty, or remedy that cannot lawfully be excluded under the Quebec Consumer Protection Act (Loi sur la protection du consommateur). Those exclusions do not apply to the extent prohibited in Quebec.

16. Indemnification

You agree to indemnify and hold harmless Kamride/BetfienInc from any claim, loss, or expense (including reasonable legal fees) arising out of your use of the Service, your content, your interactions with other Members, or your breach of these Terms — except to the extent prohibited by applicable law, including the Quebec Consumer Protection Act.

17. Suspension & Termination

Kamride may suspend or terminate your access, with or without notice, for breach of these Terms, suspected fraud or illegality, non-payment, a lawful request from authorities, prolonged inactivity, or operational/technical reasons. You may close your account at any time. Outstanding payment obligations and dispute resolution survive termination.

18. Modifications to the Service or Terms

Kamride may modify or discontinue the Service, or amend these Terms, at any time. We will give notice of material changes by email or in-app notification. Continued use after changes take effect constitutes acceptance. If you do not accept the updated Terms, you must stop using the Service.

19. Dispute Resolution & Governing Law

  • Members should first contact Kamride to resolve disputes. Kamride may, but is not obliged to, mediate, and may hold disputed funds pending resolution.
  • These Terms are governed by the laws of the Province of [PROVINCE] and the federal laws of Canada applicable therein, and the parties submit to the exclusive jurisdiction of the courts of that province.
  • Any claim must be brought within [one (1) year] of the event giving rise to it, except where a longer period is required by law.

20. General

  • Entire agreement / severability: these Terms and the Privacy Policy are the entire agreement; if any provision is held invalid, the remainder stays in effect.
  • No waiver: failure to enforce a provision is not a waiver.
  • No third-party beneficiaries, except as expressly stated.
  • Notices may be given by email, in-app message, or posting on the Service.
